Below we inform you about our general terms and conditions

1. Rental terms

The boat is equipped with all necessary rescue equipment (first aid kit, life jackets, signals, etc.) that must be used in an emergency. If they are used for no reason, the costs for the new procurement of the items will be charged or offset against the deposit. Bathing from the boat is at your own risk. Parents or persons responsible for supervision are responsible for the safety of the children. The tenant is liable for the pollution of the water and the environment caused by him. The garbage must be collected and disposed of properly on land. The customer agrees that his references or pictures may be used on the landlord's homepage or in social networks.

2. Insurance / deposit / liability

The boats have the insurance required by Spanish law. The lessor assumes no damage that is not covered by the insurance of the boat, this applies in particular to gross negligence or culpable, deliberate causing of damage. When renting the boats, a deposit of EUR 250 (for boats without a license) or EUR 1,000 (for boats that require a license) is required. Under normal circumstances, the lessee's liability is limited to the cost of damage or damage to the boat to be repaired for third parties, for which the lessee or his guests are responsible (inadvertently or intentionally) and to the amount of the deposit paid. The deposit will be refunded when the clean and undamaged boat is returned. In the event of a claim for compensation from third parties against the landlord, due to omission or due to acts by the tenant, the landlord is free from all consequences of civil and criminal liability, including the consequences of national or international court proceedings. The lessee undertakes to inform the lessor immediately by telephone of damage, accidents and other extraordinary incidents or claims, but at the latest when the boat is returned.

3. Delivery / return of the boat and inventory:

When the boat is handed over, a visual inspection of the boat and the inventory is carried out. The landlord guarantees the perfect condition of the boat, the engine and the completeness of its equipment. When the boat is returned, a new check is carried out, in which damage is checked and the completeness of the equipment is checked. The deposit will be offset against damage or loss. If the degree of pollution is high when returning the boat, a fixed amount of EUR 50 is to be paid for the final cleaning. If the return of the boat is delayed due to force majeure (e.g. strong wind, high waves), it must be done as soon as possible after the reason. The landlord must be informed immediately by telephone. At this moment the terms and conditions apply and the tenant will not be charged any penalties or additional costs. However, if the lessee delays the return of the boat to the lessor in the transfer port, the lessee will be charged a rate of 20% of the daily rental price for each hour or part thereof. In the event of a delay of more than 4 hours, a message is sent to the sea rescue service and the boat is reported as missing. The resulting costs of the sea rescue will be charged to the tenant in the event of deliberate delay.

4. Cancellation:

Should the tenant, on whose behalf the reservation was confirmed in writing, have to cancel for private reasons, this must be reported in writing. The cancellation takes effect from the date of receipt. The following cancellation rates will be charged. With a period of more than 21 days before the start of the rental; no cancellation costs. 21 to 7 days before the start of the rental: 50% of the charter amount. 7 to 0 days before the start of the rental: 100% of the charter amount.

5. Reservation:

A deposit of EUR 50 is required for boats without a license and a deposit of EUR 100 for boats that are subject to a license. The rest of the payment will be made before the rental begins. If the payment is not made, the landlord is not obliged to provide his services.

6. The area:

The lessee may only drive the boat within the region in the navigation zones in which the boat is registered and insured. The driving area of ​​the license-free boats is limited to the Bay of Alcudia (Cape Menorca to Cape Farrutx). Boats that require a license can drive to Cala Ratjada or in the west to Cape Formentor, the 2 nautical mile limit must be observed. Dangerous waves and currents can occur especially at Cape Farrutx, Cape Menorca and Cape Formentor. Should the tenant move the boat outside of the permitted navigation zone, he is requested to bring the boat to the nearest port and to leave it. If the contract ends in this way, the tenant is not entitled to repayment of the rental price and the deposit. Costs incurred due to loss of rental and return of the boat to the home port are to be borne by the tenant. Pay particular attention to the no-drive zones on beaches (yellow barrels).

7. Number of people:

The tenant may not exceed the maximum number of people in the boat during the rental period. If this is intentionally exceeded, the contract ends immediately. The tenant has to call the next port immediately and loses his deposit. In this case there is no insurance cover for the tenant. Damages are to be borne by him.

8. Use:

The boat may be used by the tenant and his guests. The boat may not be sublet or used for commercial purposes. The tenant guarantees that his behavior and that of his guests does not disturb other people and does not lead to the rental company being discredited. The tenant may not leave anyone on board who does not belong to the group of the rental. The tenant and his guests comply with the laws and regulations of Spain and the Balearic Islands, in whose territory the boat will move during the term of the contract. Smoking on board is prohibited, as is the consumption and possession of narcotic drugs or banned substances, for which the tenant bears responsibility and risk. Costs of the authorities due to sanctions / penalties are to be borne by the tenant.

9. Incident:

The tenant guarantees that his behavior and that of his guests does not disturb other people and does not lead to the rental company being discredited. The tenant may not leave anyone on board who does not belong to the group of the rental. The tenant and his guests comply with the laws and regulations of Spain and the Balearic Islands, in whose territory the boat will move during the term of the contract. 10. Complaints:

Within the framework of the contract, the landlord must be informed of all problems immediately upon occurrence and not only after the contract has ended. If this condition is not met, the landlord cannot accept any responsibility as he was not given a chance to check or solve the problem. The landlord assumes no liability if the fault was caused by the tenant, his guests or third parties or by an incident that the landlord could not have foreseen or avoided.
